Terms of Service

These are production terms adapted from a standard two-sided-marketplace template. They reference Stripe's payment terms and Australian consumer law. A qualified Australian commercial lawyer should review and tailor these before scaling beyond beta.
1. Acceptance
By creating an account, listing food, accepting deliveries, or placing an order, you agree to these terms and to our Privacy Policy. If you do not agree, do not use AirCanteen.
2. Eligibility
- You must be at least 16 years old to create an account.
- You must be at least 18 to list food as a chef or accept deliveries as a driver.
- You must provide accurate, current, and complete information.
- Chefs and drivers must hold any local council food-handling or vehicle registrations required for their activity.
3. The marketplace — our role and the cook's role
AirCanteen is a marketplace platform. We connect home cooks (sellers), customers (buyers), and delivery drivers (couriers). We facilitate the transaction; we do not prepare, handle, store, repackage, or deliver food ourselves.
Each cook is an independent food business and the seller of record for the food they list. The contract for the sale of food is between you (the customer) and the cook. Cooks are responsible for complying with all food laws that apply to their business, including the Food Standards Code, their state Food Act, and local council registration or notification requirements. Each party is independently responsible for performance of their portion of the order.
4. Food safety responsibility
The cook is responsible for the safety and suitability of the food they sell, from preparation through to delivery or handover to you — including safe handling, cooking, packaging, and maintaining safe transport temperatures (hot food hot, cold food cold) until the food reaches your hands. Cooks selling on AirCanteen must complete our food-safety verification (council registration, Food Safety Supervisor certification, and insurance) before their dishes can be listed.
5. Allergen information
Allergen and ingredient information shown on dish listings is provided by the individual cook. Cooks declare that this information is accurate and uses the prescribed Australian (PEAL) allergen names, but AirCanteen does not independently verify the contents of any dish, and home kitchens may handle allergens not listed for a specific dish.
If you have a severe food allergy or intolerance, contact the cook directly before ordering to confirm the dish is safe for you. Do not rely solely on the listing.
6. Payments
Payments are processed by Stripe, Inc. By placing an order you agree to Stripe's Connected Account Agreement and the Stripe Services Agreement. Prices are in Australian dollars and inclusive of GST where applicable. Service and delivery fees are shown at checkout.
7. Refunds and cancellations
- Customers may cancel an order at no charge while it is in "pending" status (chef has not confirmed).
- After confirmation, refunds are available only where the food fails to arrive, arrives in unsafe condition, or materially differs from the listing.
- Refund requests must be made within 24 hours of delivery via support@aircanteen.com.
- Nothing in these terms limits your rights under the Australian Consumer Law.
8. User content
You retain ownership of food photos, bios, reviews, and other content you upload. By uploading, you grant AirCanteen a worldwide, royalty-free licence to host, resize, transcode, and display that content within the service. You warrant that you have the rights to upload it.
9. Prohibited uses
- Listing alcohol, tobacco, illegal substances, or unsafe food.
- Impersonating another person or providing false identity details.
- Using the platform to harass, defraud, or harm others.
- Bypassing payment via off-platform transactions.
- Reverse-engineering, scraping, or abusing the API.
10. Account suspension and termination
We may suspend or terminate your account for breach of these terms, fraud, safety risk, or as required by law. You may close your account at any time via support@aircanteen.com.
11. Disclaimers
To the maximum extent permitted by law, AirCanteen provides the platform "as is". We do not warrant that the service will be uninterrupted or error-free. We are not liable for the acts or omissions of chefs, drivers, or customers.
12. Limitation of liability
To the maximum extent permitted by law, our aggregate liability for any claim arising out of or relating to the service is limited to the greater of (a) AUD 100 or (b) the fees you have paid to AirCanteen in the 12 months prior to the claim. Nothing in this clause limits liability that cannot be excluded under the Australian Consumer Law.
13. Governing law
These terms are governed by the laws of Victoria, Australia. Disputes will be resolved in the courts of Victoria.
14. Changes to these terms
We may update these terms. The "Effective" date above will change when we do. Material changes will be announced via email; continued use of the service after the effective date constitutes acceptance of the updated terms.
